Terms of Service

TRADEWIND is a publication. It gives every subscriber the same general market information. It is not personalized investment advice, we are not a registered investment adviser or broker-dealer, and we never hold, manage or have access to your money. You make and place every trade yourself, and you can lose money, including large amounts.

1. Who we are

TRADEWIND Signals ("TRADEWIND", "we", "us") is operated by EverInfinite LLC, a Texas limited liability company. These Terms are an agreement between you and EverInfinite LLC. By creating an account, starting a trial or using tradewindsignals.com (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service is

The Service is a subscription publication. Each trading day near the US market close we publish the output of a systematic, rules-based model: which one of a small set of exchange-traded funds the model holds, a plain-English market summary, and a notice when the model's holding changes. It is delivered through our website, email and Telegram.

The content is the same for every subscriber. We do not consider your finances, goals, taxes or risk tolerance, and nothing we publish is a recommendation that any investment is suitable for you.
We do not answer questions about your personal situation, give one-on-one advice, manage accounts, or place trades for subscribers. Please do not ask us to.
Portfolio figures you see in your account (for example, what an amount you enter would be worth) are estimates calculated from the model's published history. They are not your actual brokerage results.

3. Performance and risk

Long-term performance figures on the site are hypothetical and backtested. They were produced with the benefit of hindsight, apply estimated trading costs, and do not reflect real trading over most of the period shown. Hypothetical results have inherent limitations, and actual results will differ.
Past performance, real or hypothetical, does not guarantee future results.
The model can hold leveraged exchange-traded funds. Leveraged funds can fall much faster than the market and carry compounding and decay risks. The backtest has had peak-to-trough losses of about 40%, and losses of 55% or more are possible.
Signals can be late, wrong or missed because of data errors, market events, outages or other causes outside our control. Market data comes from third parties and may be inaccurate or delayed.
You are solely responsible for your investment decisions and their results. Consider consulting a licensed professional before investing.

4. Our own trading

EverInfinite LLC and its owner trade the same model in their own accounts, typically within minutes after a signal is published to subscribers. The model holds large, highly liquid index and defensive funds, and our own positions are small relative to their trading volume. We do not trade against our published signal, and we will not trade ahead of a signal we have not yet published.

5. Accounts

You must be at least 18 years old and able to form a binding contract.
Give accurate information and keep your password secure. You are responsible for activity on your account.
Your subscription is for you personally. Do not share your login, and do not copy, resell, republish or redistribute the signal or other subscriber content, in whole or in part, without our written permission.

6. Subscriptions, trials and billing

Payments are processed by Stripe. We never see or store your full card number.
Free trial. New members get a 7-day free trial, one per person, card and phone number. A card is required to start it. If you do not cancel before the trial ends, your subscription starts and your card is charged automatically.
Automatic renewal. Subscriptions renew automatically each month or year, depending on your plan, at the then-current price for your plan until you cancel.
Cancelling. You can cancel any time from Manage billing in your account. Cancellation takes effect at the end of your current paid period, and you keep access until then.
Refunds. Payments are non-refundable, including for partial periods and unused time, except where required by law. If you believe you were charged in error, email us and we will look into it.
Price changes. We may change prices for new subscribers at any time. We will give existing subscribers at least 30 days' notice before a price change affects them. Founding-member pricing stays in place as long as your subscription stays active without interruption.

7. Acceptable use

Do not misuse the Service: no scraping, automated bulk access, attempts to break security, reverse engineering, or use that breaks the law. We may suspend or end accounts that do, without refund.

8. Intellectual property

The Service, the model, the signals, our writing, charts and branding belong to EverInfinite LLC. We grant you a personal, non-transferable license to use them for your own investing while your subscription is active.

9. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise the Service will be uninterrupted, error-free or profitable.

10. Limitation of liability

To the fullest extent allowed by law, EverInfinite LLC and its owner are not liable for any trading or investment losses, lost profits, or indirect, incidental, special or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Indemnity

You agree to cover our reasonable losses and costs from claims caused by your breach of these Terms or your misuse of the Service.

12. Ending the Service

You may stop using the Service at any time. We may suspend or end your access if you break these Terms. We may also discontinue the Service, and if we do, we will refund the unused part of any prepaid period.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Fort Bend County, Texas, and you and we consent to their jurisdiction. Please email us first; most problems can be solved quickly.

14. Changes

We may update these Terms. If a change is material, we will email subscribers before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
